PA1A — Probate Application (Without a Will / Letters of Administration)
Application for letters of administration where the deceased died intestate (without a valid will). The court appoints an administrator to deal with the estate according to the intestacy rules.
Who uses this form
The next of kin entitled under the intestacy rules (usually spouse/civil partner first, then adult children, then other relatives) who wish to administer the estate.
When to use it
Apply when the deceased left no valid will. The order of priority for administration is set out in the Non-Contentious Probate Rules 1987. Multiple entitled persons must either apply together or renounce.

£273 for estates over £5,000 (free for estates under £5,000).

Common mistakes to avoid
Applying when others have equal or higher priority — you may need a renunciation from those with higher priority
Not following the intestacy rules to establish who benefits — the rules are strict and may produce unexpected results
Failing to pay any inheritance tax due before applying
Not checking whether a will exists — search the National Will Register and ask family members
Misunderstanding the 'spouse's statutory legacy' under the Inheritance and Trustees' Powers Act 2014
