CCA Section 77/78 Request — Copy of Credit Agreement

A formal request to a creditor for a copy of your consumer credit agreement and related statements under sections 77–78 of the Consumer Credit Act 1974.

When to use this template

Use this letter when a creditor is claiming you owe money under a regulated consumer credit agreement (such as a credit card, personal loan, or hire-purchase agreement) and you want to verify the terms of the agreement, challenge enforceability, or understand precisely what you are alleged to owe. Under s.77/78, the creditor must supply a copy within 12 working days or the agreement becomes unenforceable while the default continues.

When NOT to use this template

This request only applies to regulated consumer credit agreements under the Consumer Credit Act 1974 — it does not apply to mortgages, business credit, overdrafts, or charge cards repayable in full each month. Do not use this letter as a delay tactic without genuine grounds for querying the agreement — courts take a dim view of unmeritorious defences.

Legal Basis

Consumer Credit Act 1974 ss.77 (fixed-sum credit), 78 (running-account credit), 79 (hire agreements); The Consumer Credit (Prescribed Periods for Giving Information) Regulations 1983 (12 working days to comply); Consumer Credit (Agreements) Regulations 2010; while a creditor is in default of an s.77/78 request, the agreement is unenforceable (but not void) under CCA 1974 s.77(4)/78(6).

  • Sending the request to a debt collector rather than the original creditor or their authorised agent
  • Confusing an s.77/78 request with a DSAR — they are entirely different rights with different time limits and scope

Common Mistakes to Avoid

  • Forgetting to enclose the statutory fee of £1 (still required under the CCA 1974 — send a postal order)
  • Sending the request to a debt collector rather than the original creditor or their authorised agent
  • Confusing an s.77/78 request with a DSAR — they are entirely different rights with different time limits and scope
  • Assuming that an unenforceable agreement means the debt is written off — it is merely unenforceable while the default continues; once the creditor complies the agreement becomes enforceable again
  • Not keeping a copy of the letter and proof of postage — the 12-working-day clock runs from receipt

I write in connection with the above account. I am exercising my statutory right to request a copy of the executed credit agreement and related documents under sections [APPLICABLE CCA SECTION] of the Consumer Credit Act 1974 (as amended by the Consumer Credit Act 2006).

**My Request**

Pursuant to section [APPLICABLE CCA SECTION] of the Consumer Credit Act 1974, I request that you provide me with:

1. A true copy of the executed credit agreement relating to the above account, including all terms and conditions applicable at the time the agreement was signed and any subsequent variations properly notified to me.
2. A statement of the account showing:
   (a) the total sum paid under the agreement by the debtor;
   (b) the total sum which has become payable under the agreement but remains unpaid, and the various amounts comprised in that total sum, with the date when each became due; and
   (c) the total sum which is to become payable under the agreement by the debtor, and the various amounts comprised in that total sum, with the date, or mode of determining the date, when each becomes due.
3. A copy of any notice of assignment if the debt has been assigned.

**The Statutory Fee**

I enclose a postal order for £1.00 in payment of the statutory fee prescribed by the Consumer Credit (Prescribed Periods for Giving Information) Regulations 1983.

**Your Obligations**

Under sections 77(1)/78(1) of the Consumer Credit Act 1974, you are required to comply with this request within **12 working days** of receiving it and the £1.00 fee. If you fail to comply within that period, the agreement will be unenforceable against me for as long as the default continues, pursuant to sections 77(4)/78(6) of the Act.
