IAFT-1Notice of Appeal to the First-tier Tribunal (Immigration and Asylum Chamber) — In-Country

Used by individuals in the UK to appeal a Home Office immigration or asylum decision to the First-tier Tribunal (Immigration and Asylum Chamber).

Who uses this form

Persons in the UK who have received a refusal of a visa, leave to remain, protection claim, or deportation decision and who have an in-country right of appeal.

When to use it

File within 14 days of receiving the Home Office decision (or 5 days if detained). Check the decision letter carefully — it will state the appeal deadline and whether an in-country right of appeal exists.

Where to file

First-tier Tribunal (Immigration and Asylum Chamber) — online via MyHMCTS or by post/email to the relevant regional tribunal centre.

Time limit / deadline

14 days from receiving the Home Office decision (5 days if detained).

Court fee

£80 (paper determination, no oral hearing); £140 (oral hearing).

Fee remission

Help with Fees (EX160) is not available for immigration tribunal fees. Legal aid is available for asylum and some human rights cases — contact an immigration legal aid solicitor.

Common mistakes to avoid

Missing the strict appeal deadline — the tribunal has very limited power to extend time

Not identifying all the grounds of appeal clearly — human rights, asylum, and immigration grounds are distinct

Appealing a decision for which there is no statutory right of appeal

Not including the Home Office reference number and decision letter

Not checking whether Legal Aid is available before paying the fee privately
