Response to Probate Caveat Warning

Formal response by a caveator to a warning issued by the probate registry, preserving the caveat and entering an appearance, under the Non-Contentious Probate Rules 1987.

When to use this template

Use this response when you have entered a caveat at the probate registry to prevent a grant of probate being issued, and you have received a Warning from the person applying for probate. You must enter an Appearance (Form NC8) at the probate registry within 14 days of the Warning being served, or the caveat will be set aside. This letter accompanies or replaces the formal appearance if you are asserting a contrary interest.

When NOT to use this template

The appearance must be filed at the probate registry — this letter alone is not a substitute for filing Form NC8. Take specialist probate litigation advice urgently, as the 14-day deadline for entering an appearance is strict. If you have no opposing interest and entered the caveat in error, it may be simpler to withdraw it rather than entering an appearance.

Legal Basis

Non-Contentious Probate Rules 1987 (SI 1987/2024), rules 44–46 (caveats, warnings, and appearances); Senior Courts Act 1981, s.48 (probate jurisdiction). A caveator who enters an appearance and the person who issued the warning become adversaries in probate proceedings, which must be commenced in the Chancery Division.

Common Mistakes to Avoid

  • Missing the strict 14-day deadline to enter an appearance after the Warning — the caveat will be automatically set aside
  • Not filing the formal Form NC8 at the probate registry as well as sending this letter
  • Entering an appearance without legal advice where the grounds for the caveat are weak — costs may be awarded against an unsuccessful caveator
  • Not identifying clearly the basis of your opposing interest in the estate (e.g. you are a beneficiary under a later will; you dispute the testator's testamentary capacity)
