Section 75 Credit Card Claim Letter

Make a claim against your credit card issuer under Section 75 of the Consumer Credit Act 1974 where a supplier has failed to deliver goods or services.

When to use this template

Use this when a retailer or service provider has breached their contract (e.g. failed to deliver, supplied faulty goods, gone into administration) and you paid for the goods or services using a credit card, for a purchase between £100 and £30,000. Section 75 makes the credit card issuer jointly and severally liable with the supplier.

When NOT to use this template

Section 75 does not apply to debit card purchases (use chargeback instead). It does not apply to purchases under £100 or over £30,000. It does not apply where a third party processed the payment (e.g. PayPal transactions may not be covered — check your card terms).

Legal Basis

Consumer Credit Act 1974, s.75 (liability of creditor for misrepresentation and breach of contract by supplier). The credit card issuer is jointly and severally liable with the supplier for the breach. Section 75A applies to linked credit agreements (e.g. store finance over £30,000).

Common Mistakes to Avoid

  • Claiming against the bank before first trying to resolve the matter with the supplier
  • Not providing evidence of the supplier's breach (e.g. proof of non-delivery, correspondence with supplier)
  • Using Section 75 for debit card purchases — debit cards are covered by chargeback, not s.75
  • Claiming for a purchase under £100 — the statutory protection only applies above £100
