Common mistakes to avoid

Using MCOL for unspecified or unliquidated claims (e.g. general damages for personal injury) — issue a paper N1 instead

Not having the defendant's current address — judgment cannot be enforced without a valid address

Failing to follow the relevant pre-action protocol before issuing (e.g. Pre-Action Protocol for Debt Claims)

Claiming compound interest when only simple statutory interest (8% under the Judgments Act 1838) is available

Issuing against a limited company using the trading name rather than the registered company name
