Challenging a Council Tax Band

How to challenge the council tax valuation band of your property if you believe it is too high.

Overview

Every domestic property in England is assigned a council tax valuation band (A to H) based on its open market value as at 1 April 1991. If you believe your property is in the wrong band — for example, because comparable properties in your area are in a lower band — you may be able to challenge it. Be aware that a challenge can result in your band going up as well as down.

Who Can Use This Process

  • You are the council tax payer for the property
  • You believe the property is in the wrong band compared to similar properties
  • You have recently moved into the property (within 6 months), or there has been a material change (e.g., demolition, adaptation for disabled person), or you believe there was an error in the original banding

Step-by-Step Process

1

Check comparable properties

Use the Valuation Office Agency (VOA) website to check the bands of similar properties in your street or area. If comparable properties are in a lower band, you may have grounds to challenge.

Timeframe: 1-2 hours
Practical Tips
  • Focus on properties that are very similar in size, type, and age
  • Check at least 5-10 comparable properties
  • Remember: bands are based on 1991 values, not current values
2

Contact the VOA informally first

Before making a formal challenge, contact the VOA to discuss your concerns. They may agree to review your banding informally, which avoids the risk of your band being increased.

Timeframe: 1-4 weeks
3

Make a formal proposal to the VOA

If informal contact doesn't resolve the issue, make a formal proposal to the VOA to alter your band. You can do this online through the GOV.UK website.

Timeframe: 1 day
4

VOA considers the proposal

The VOA will review your proposal and may accept it, reject it, or propose a different band (which could be higher). They should respond within 2 months.

Timeframe: Up to 2 months
5

Appeal to the Valuation Tribunal

If the VOA rejects your proposal or you disagree with their decision, you can appeal to the Valuation Tribunal for England (VTE). The appeal is free and hearings are informal.

Timeframe: 3-6 months

Important Warnings

A challenge can result in your band going UP, not just down. The VOA can also review neighbouring properties, potentially increasing their bands too.

You must continue paying council tax at the current rate while any challenge is ongoing. If your band is reduced, you will receive a refund.

If you are challenging because of a material change (e.g., property reduced in size), you must make the proposal within 6 months of the change.

Frequently asked questions

How long does the challenging a council tax band process take?
The end-to-end timeline depends on which stage you're at. Common steps run on these timeframes: "1-2 hours"; "1-4 weeks"; "1 day"; "Up to 2 months". Add court / counterparty response time on top — disputed matters can run months longer than the bare minimum.
How much does it cost?
Main outlays are: VOA proposal — Free; Valuation Tribunal appeal — Free; Professional surveyor (optional) — £200-£500. Court fees often qualify for Help with Fees remission if you're on a low income. Solicitor fees are extra and vary widely — many matters can be done as a litigant in person.
What are the most common mistakes to avoid?
Watch out for: A challenge can result in your band going UP, not just down. The VOA can also review neighbouring properties, potentially increasing their bands too.; You must continue paying council tax at the current rate while any challenge is ongoing. If your band is reduced, you will receive a refund.; If you are challenging because of a material change (e.g., property reduced in size), you must make the proposal within 6 months of the change.. If you're unsure on any of these, get advice from a regulated solicitor or a free service like Citizens Advice before acting.
Where can I find the official forms and guidance?
The official sources are: VOA — Check and challenge your council tax band; Valuation Tribunal for England. Always use the forms / guidance from the issuing authority's own site — third-party copies can be out of date.
Can I do this myself without a solicitor?
Yes — many people complete this kind of matter as a litigant in person. The site walks through each step in plain English. A solicitor is recommended if: large sums are at stake, the other side has legal representation, the matter involves criminal liability, children, immigration, or you're unsure on any procedural deadline. Free advice is available from Citizens Advice, Law Centres, and (for some matters) LawWorks pro bono clinics.
