When to use this tool
Use if your landlord has failed to protect your deposit in a government-approved scheme within 30 days, protected it late, or failed to provide the prescribed information. Under Housing Act 2004 s.214, the court can order between one and three times the deposit amount as a penalty in addition to ordering the return of the deposit. This tool estimates the likely range.

How this works
Housing Act 2004 s.213 requires landlords to protect deposits in a government-approved scheme within 30 days and to provide the tenant with prescribed information. Under s.214, the court can order the landlord to repay the deposit and pay a penalty of between 1ร and 3ร the deposit amount.
Prescribed information includes: the scheme leaflet, the scheme certificate, and information about how to raise a dispute.
