When to use this tool

Use as soon as you suffer a personal injury or discover that an injury was caused by another party's fault. The 3-year limitation period under s.11 of the Limitation Act 1980 runs from the date of the accident or the date you first had knowledge that the injury was significant and attributable to the defendant. For claimants who were under 18 at the time of injury, time does not begin to run until their 18th birthday.

  • Limitation Act 1980 s.28 โ€” Disability (minority and mental incapacity): time does not run while the disability subsists.
  • Limitation Act 1980 s.33 โ€” Court's broad discretion to disapply the 3-year period where equitable to do so.
