Universal Credit Overpayment Dispute Letter

Letter disputing a DWP Universal Credit overpayment decision or asking for slower recovery on hardship grounds.

When to use this template

Use to dispute the existence or amount of a UC overpayment, OR to request a reduced recovery rate where deductions are causing hardship. UC overpayments are almost always recoverable (s.71ZB Social Security Administration Act 1992) — challenges focus on the factual basis or the recovery method.

When NOT to use this template

Do not use to appeal sanctions (different MR + tribunal route). Do not use to dispute the underlying calculation of your UC award (use MR on the award decision instead).

Legal Basis

Social Security Administration Act 1992 s.71ZB (Universal Credit recovery); Welfare Reform Act 2012 s.105; Universal Credit, PIP, JSA and ESA (Decisions and Appeals) Regulations 2013. Recovery is mandatory regardless of fault; the only routes are dispute of factual basis, waiver on hardship grounds, or recovery-rate reduction.

Common Mistakes to Avoid

  • Assuming a DWP-error overpayment is not recoverable — under UC, almost all overpayments are recoverable regardless of cause
  • Not requesting the overpayment breakdown — DWP must provide it on request
  • Missing the 1-month MR deadline for any decision-based dispute
  • Confusing waiver (rare, hardship-based) with dispute (factual)
  • Not asking for a slower recovery rate when deductions are causing hardship
