Section 43E — Disclosure to Minister of the Crown.

[F1 A qualifying disclosure is made in accordance with this section if—]

(a) [F1 the worker’s employer is—]

(i) [F1 an individual appointed under any enactment [F2 (including any enactment comprised in, or in an instrument made under, an Act of the Scottish Parliament)] by a Minister of the Crown [F2 or a member of the Scottish Executive], or]

(ii) [F1 a body any of whose members are so appointed, and]

(b) [F1 the disclosure is made ... to a Minister of the Crown [F2 or a member of the Scottish Executive ] . ]
