Section 15 — Procedure for regulations under section 14

(1) Subject to subsection (3), regulations under section 14 that contain provision—
(a) amending or repealing a provision of an Act of Parliament,
(b) creating a civil sanction or varying the maximum amount of any monetary penalty, or
(c) creating a criminal offence,
are subject to the draft affirmative procedure.
(2) Subsection (3) applies where the provision within subsection (1) of this section relates to a decision under Article 24(1) of the Agreement.
(3) Where the Secretary of State considers that the regulations need to be made urgently in order to give effect to the measure to which they relate, the regulations are subject to the made affirmative procedure.
(4) Any other regulations under section 14 are subject to the negative procedure.
