Muirburn was previously regulated under the Hill Farming Act 1946 (“ the 1946 Act ”). Part 2 of the Wildlife Management and Muirburn (Scotland) Act 2024 (“ the 2024 Act ”) establishes a licensing scheme for the carrying out of muirburn. This scheme replaces the 1946 Act regime on 15 September 2026 when Part 2 of the 2024 Act comes fully into force and the majority of the muirburn provisions in the 1946 Act are repealed.
These Regulations make consequential amendments to secondary legislation relating to the environment in Scotland as a result of the commencement of Part 2 of the 2024 Act.
