Explanatory note

These Regulations are made by the Welsh Ministers and bring into force provisions of the Agriculture Act 2020 (c. 21) (“the Act”).

Regulation 2(a) brings into force, on 1 January 2021, paragraphs 7 and 8 of Part 2 of Schedule 5 to the Act.

Regulation 2(b) brings into force, on 1 January 2021, section 46 of the Act so far as relating to those paragraphs.

Paragraph 7 of Schedule 5 provides for the Welsh Ministers to make and publish a declaration that there are “exceptional market conditions” (as defined in that paragraph) which justify the making available of powers conferred by paragraph 8 of Schedule 5.

Paragraph 8 of Schedule 5 provides that the Welsh Ministers may, while a declaration made under paragraph 7 has effect, give, or agree to give, financial assistance to agricultural producers in Wales, subject to such conditions as the Welsh Ministers consider appropriate.
