How the stop-the-clock rule works (ERA 1996 s.207B)
- Your standard deadline is 3 months less 1 day from the date of the act complained of.
- When you contact ACAS for Early Conciliation, the clock stops on Day A (the date ACAS notified you it received your request).
- The clock restarts on Day B + 1 (the day after the EC Certificate is issued).
- Your extended deadline = original deadline + (Day B โ Day A) + 1 day.
For unfair / constructive dismissal: your Effective Date of Termination (EDT). For discrimination: the date of the discriminatory act (or last act in a series).
From your EC Certificate โ the date ACAS sent notification it received your request.
From your EC Certificate โ the date ACAS issued the certificate closing conciliation.
