When to use this tool

Use immediately after receiving your ACAS Early Conciliation Certificate. The certificate shows Day A (when ACAS was notified) and Day B (when the certificate was issued). The time between Day A and Day B is added to your original ET deadline โ€” plus one further day. Use this calculator to find your exact extended deadline and check how many days remain.

How the stop-the-clock rule works (ERA 1996 s.207B)

  • Your standard deadline is 3 months less 1 day from the date of the act complained of.
  • When you contact ACAS for Early Conciliation, the clock stops on Day A (the date ACAS notified you it received your request).
  • The clock restarts on Day B + 1 (the day after the EC Certificate is issued).
  • Your extended deadline = original deadline + (Day B โˆ’ Day A) + 1 day.

For unfair / constructive dismissal: your Effective Date of Termination (EDT). For discrimination: the date of the discriminatory act (or last act in a series).
