Education and SEND

EHCP, SEND Tribunal, school exclusions, admissions appeals, disability discrimination, and OIA university complaints.

Overview

Education law splits between schools (admissions, exclusions, SEND, bullying) and universities (academic appeals, OIA). For SEND, the central instrument is the Education, Health and Care plan under Part 3 Children and Families Act 2014. Parents have a statutory right to request an EHC needs assessment and to appeal LA decisions to the SEND Tribunal (HESC Chamber).

When to get advice

SENDIAS (statutory, free, in every LA) and IPSEA / Coram Children's Legal Centre provide specialist SEND advice. For exclusions, contact your Local Authority's exclusion review service. Legal aid for SEND tribunal appeals is rarely available.
