These Regulations amend the Education (Student Support) (Wales) Regulations 2018 (“ the 2018 Regulations ”).

The 2018 Regulations provide for financial support for eligible students taking designated courses of higher education which begin on or after 1 August 2018.

These Regulations amend—

the power to designate courses under regulation 8 of the 2018 Regulations, so that the Welsh Ministers may specify that such a course is to be treated as being provided by an ordinary provider for the purposes of calculating the maximum amount of tuition fee loan under regulation 40 of the 2018 Regulations, and

regulation 40 of, and insert a new Schedule 2A into, the 2018 Regulations to ensure students on continuing courses listed in that Schedule are entitled to the fee loan applicable to an ordinary provider.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations.
